Management and Collection of Personal Data

The ECODIS France platform collects personal data essential for service operation as well as data to improve the user experience (statistical data), which will be retained for a maximum period of 12 months after the end of the contractual relationship.

For each processing of personal data, ECODIS France takes all reasonable measures to ensure the accuracy and relevance of personal data with regard to the purposes for which it is processed.

The Client is informed of the regulations regarding marketing communication, the Law of June 21, 2014, on Confidence in the Digital Economy, the Data Protection and Freedom Act of August 6, 2004, and the General Data Protection Regulation (GDPR: No. 2016-679).

Purpose of Data Collection

With the prior consent of users, ECODIS France may collect and process some or all of the following data:

  • To provide you with the information or services you have requested (such as sending a commercial offer); and/or
  • To gather information that allows us to improve our platform, products, and services (particularly through cookies); and/or
  • To be able to contact you regarding various events related to our platform.

ECODIS France does not sell your personal data; it is used solely as necessary or for statistical and analysis purposes.

Right of Access, Rectification, and Objection

In accordance with current European regulations, ECODIS France users have the following rights:

  • Right of access (Article 15 of the GDPR) and rectification (Article 16 of the GDPR), to update, complete, restrict, or delete users' personal data (Article 17 of the GDPR) when it is inaccurate, incomplete, ambiguous, outdated, or if its collection, use, disclosure, or retention is prohibited.
  • Right to withdraw consent at any time (Article 13-2c of the GDPR).
  • Right to restrict the processing of user data (Article 18 of the GDPR).
  • Right to object to the processing of user data (Article 21 of the GDPR).
  • Right to data portability, allowing users to receive their data in a structured format when such data is processed automatically based on their consent or a contract (Article 20 of the GDPR).
  • Right to determine the fate of user data after their death and to specify whether we should disclose (or not) such data to a third party previously designated.

If ECODIS France is notified of a user’s death and has no instructions, we commit to destroying the data unless retention is required for probative purposes or to comply with a legal obligation.

In this case, the user must specify the personal data they wish to update or delete, providing precise identification with a copy of an ID (ID card or passport).

Non-Disclosure of Personal Data

ECODIS France undertakes not to process, host, or transfer any customer information collected to a country outside the European Union or recognized as "non-adequate" by the European Commission without first informing the customer. Nevertheless, ECODIS France remains free to select its technical and commercial subcontractors, provided they offer sufficient guarantees regarding the requirements of the General Data Protection Regulation (GDPR: No. 2016-679).

ECODIS France commits to taking all necessary precautions to safeguard the security of the information and to prevent its disclosure to unauthorized persons. However, if an incident affecting the integrity or confidentiality of customer information comes to ECODIS France’s attention, it will promptly inform the customer and communicate the corrective measures taken. Additionally, our platform does not collect any "sensitive data."

User personal data may be processed by ECODIS France subsidiaries and/or subcontractors (service providers), solely to achieve the purposes of this policy.

Hyperlinks

The platform may contain a number of hyperlinks to other sites, established with the permission of ECODIS France. However, ECODIS France has no control over the content of these sites and, therefore, assumes no responsibility for them.

Cookies

A "cookie" is a small information file sent to the user's browser and stored on the user's device (e.g., computer, smartphone) (hereinafter "Cookies"). This file does not in any way risk damaging the user's device.
v The platform may process information about the user’s visit, such as pages viewed and searches performed. This information allows ECODIS France to enhance the content of the platform and improve user navigation.
v Cookies that facilitate navigation and/or provide the services offered by the platform can be managed by the user. The user can configure their browser to decide whether or not to accept cookies, allowing them to either be stored on the device or rejected, either systematically or based on their issuer. In such cases, ECODIS France disclaims any responsibility for the degraded performance of the platform and the services that may be offered, resulting from (i) the user's refusal of cookies, or (ii) the inability of ECODIS France to store or consult cookies necessary for their operation due to the user's choices. For managing cookies and user preferences, each browser’s configuration is different and can be found in the browser's help menu to modify cookie settings.

Finally, by clicking on the social media icons for Twitter, Facebook, and LinkedIn displayed on the platform or its mobile app, and if the user has accepted cookies while continuing to browse the platform, Twitter, Facebook, and LinkedIn may also place cookies on the user's devices (computer, tablet, smartphone).

Security

To ensure the security and confidentiality of personal data, the platform uses secure networks protected by standard measures such as firewalls, pseudonymization, encryption, and password protection.

When processing personal data, ECODIS France takes all reasonable measures to protect it from loss, misuse, unauthorized access, disclosure, alteration, or destruction.

Despite our efforts, no transmission method over the Internet and no electronic storage method is completely secure. Therefore, we cannot guarantee absolute security.

If we become aware of a security breach, we will notify affected users so they can take appropriate action. Our incident notification procedures account for our legal obligations at the national or European level. We commit to fully informing our clients of any security-related issues regarding their accounts and to providing them with all necessary information to help them meet their own regulatory reporting obligations.

Applicable Law and Jurisdiction

Any dispute related to the use of the site is subject to French law. Except where the law does not permit it, exclusive jurisdiction is granted to the competent courts.
